The Texas Commission on Environmental Quality (TCEQ) admitted in December of 2013 and April of 2014 in two separate court hearings in Briscoe County to having no authority over privately owned ground water.

A Texas Tech University and other university and independent studies have shown the aquifer to be self regulating and will accomplish more than the 50/50 desired future condition without pumping restrictions. This has recently been acknowledged and confirmed by an expert hydrologist hired by the High Plains Water District.
